Mr. Simonitsch provides companies with strategic advice to help them identify, assess, minimize, and prepare for legal enterprise risks that may interfere with business operations and objectives. Relying on his experience in a variety of legal fields, and past service as in-house counsel, Mr. Simonitsch advises clients on all facets of litigation and legal risk management.

As a complex commercial litigator for more than sixteen years, Mr. Simonitsch effectively and efficiently resolved disputes through negotiated settlements, mediations, arbitrations, and trials in an array of industries. He successfully represented clients in matters including: broken contracts, fraud, deceptive and unfair trade practices, corporate officer fiduciary duties, business break-ups, toxic torts, insurance coverage, machinery defect and related personal injuries, employer vicarious liability, lien and mortgage foreclosures, wage and hour violations, employment discrimination, and judgment collections. He has also litigated construction lien foreclosures, construction defect, mold, and delay claims for general contractors, subcontractors, and materialmen. Mr. Simonitsch also has extensive experience representing banks, private equity investors, asset-based lenders, and other creditors in bankruptcy court and state court insolvency proceedings, including stay relief motions, use of cash collateral, asset sales, preference claims, and fraudulent transfer actions.

In addition to speaking nationally on substantive legal issues, Mr. Simonitsch speaks across the country on corporate diversity and inclusion strategies. He is a past president of the National Asian Pacific American Bar Association, and was featured in the 2014 Lawyers of Color “Power List,” a comprehensive catalog of the nation’s most influential minority attorneys.
